THIS MATTER having a come before the Court, upon the Plaintiff FAYE L. BREWER’s Motion to Reset Foreclosure Sale and for disbursement of funds in Court Registry forfeited by high bidder; and the Court being otherwise fully advised in the premises, it is
ORDERED AND ADJUDGED that:
1. This Court entered a Final Judgment of Foreclosure in favor of Plaintiff on December 5, 2024.
2. The foreclosure sale was held on February 19, 2025, however the high bidder failed to pay the balance due on its bid, forfeiting its deposit.
3. The Clerk shall reset the foreclosure sale; the clerk shall readvertise the sale and pay all costs of the sale from the deposit. If the Plaintiff incurs advertising costs, a supplemental affidavit of amounts, if timely submitted, may be considered to add to the total amounts due under the judgment. Any remaining funds of the forfeited deposit shall be applied toward the judgment. Section 45.031(3), Fla. Stat.
4. If the total sum with interest at the rate prescribed by law and all costs of this action accruing subsequent to this Court’s judgment are not paid, the Clerk of the Court shall sell the property at public sale on May 6, 2025, to the highest bidder for cash, except as set forth in the Final Judgment of Foreclosure, at the courthouse located at190 Governmental Center in Escambia County in Pensacola, Florida, in accordance with Section 45.031, Florida Statues, using the following method:
