STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION NOTICE OF  ISSUANCE OF CONDITIONAL SITE REHABILITATION COMPLETION ORDER (SRCO) 

 

The Department of Environmental Protection (Department) gives notice of agency action issuing a Conditional Site Rehabilitation Completion Order (SRCO) pursuant to and in conformance with the criteria in Chapter 62-780, Florida Administrative Code (F.A.C.). The SRCO was issued to Runship, L.L.C. (Runship), the owner of property located at Barrancas Avenue and McLeod Street, Pensacola, Escambia County, Florida. The Department assigned FDEP Facility Site ID #8626786, COM_66742, BF 170701001 to the Site, also known as the Former Runyan’s Shipyard Facility.

 

The SRCO was issued in response to documentation submitted by Runship with its Institutional Control Modification Request. The Institutional Control Modification Request was prepared pursuant to a Brownfields Site Rehabilitation Agreement (the Agreement), FDEP# BF170701001, executed by the Department on December 26, 2007, to address contamination at the Site. The Department determined that it has reasonable assurance that Runship has met the criteria in Chapter 62-780, F.A.C., and has met the terms of the Agreement, including the commitments set forth in the technical submittals with respect to the implementation of engineering controls and recordation of institutional controls. The technical submittals demonstrated that acceptable Alternative Cleanup Target Levels have been established for soil and groundwater contaminants remaining at the Site.

Questions regarding legal issues should be referred to the Department’s Office of General Counsel at (850) 245-2242. Contact with any of the above does not constitute a petition for administrative hearing.

 

A person whose substantial interests are affected by this Order (the SRCO) may petition for an administrative hearing under sections 120.569 and 120.57, F.S. The petition must contain the information set forth below and must be filed (received) by the Agency Clerk in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, MS 35, Tallahassee, Florida 32399-3000, within 21 days of publication of this notice. Petitioner shall mail a copy of the petition to Runship, L.L.C., at the time of filing. Notice to Runship, L.L.C. shall be directed to Mr. Eric J. Nickelsen, Registered Agent, Runship, L.L.C., P. 0. Failure to file a petition within 21 days of publication of this notice shall waive the right of anyone who may request an administrative hearing under sections 120.569 and 120.57, F.S.
