STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION NOTICE OF ISSUANCE OF CONDITIONAL SITE REHABILITATION COMPLETION ORDER (SRCO)

 

The Department of Environmental Protection (“Department”) gives notice of agency action issuing a Conditional Site Rehabilitation Completion Order (“SRCO”) pursuant to and in conformance with the criteria in Chapter 62-780, Florida Administrative Code (“F.A.C.”). The SRCO was issued to James W. Bradley and Robert O. Beasley, as Personal Representative of the Estate of Donald W. Moore (“Owners”), the owners of property located at 2710 N. Palafox Street, Pensacola, Escambia County, Florida. The Department assigned FDEP Facility Site ID COMET ID No. 329486 to the Site, also known as the Former Kaiser Agriculture Chemical Property (“Property”).

 

The SRCO was issued in response to documentation submitted by Owners with their Site Assessment Report, and amendments thereto. These reports confirm that while contaminated groundwater exists beneath the property, the groundwater contamination did not originate from the Property and current soil condition does not contribute to the groundwater contamination beneath the surface of the Property. The Department determined that although a long-term groundwater use restriction is required, the groundwater condition does not warrant active remediation on the Property. The Department determined that with the imposition of institutional controls prohibiting the extraction of groundwater, and the recording of the institutional controls, it has reasonable assurance that Owners met the criteria in Chapter 62-780, F.A.C.
